Terms of use
The agreement governing access to Cheqzen's website and SMS safety check-in platform.

These Terms of Use form an agreement between Cheqzen Pty Ltd and the organisation purchasing or using the service. If you create an account, accept an order or use the service for an organisation, you confirm that you are authorised to bind that organisation.
1. Agreement and eligibility
These terms apply to the Cheqzen website, customer portal, related support and safety check-in services. They operate together with the order or checkout summary, our Privacy Policy and any written service schedule we agree with you. If an order conflicts with these terms, the order controls only for the specific commercial detail it addresses.
You must be at least 18 years old and have authority to act for the subscribing organisation. The service is currently designed for Australian organisations and Australian mobile numbers. An organisation's country is set during onboarding and cannot be changed by customer administrators. A genuine correction or future relocation must be reviewed by Cheqzen.
2. What Cheqzen provides
Cheqzen provides tools for organisations to configure worker records, supervisors and schedules, send SMS safety check-ins, record replies, issue reminders, escalate missing responses and review activity. Features and capacity depend on the selected plan and add-ons.
3. Customer safety responsibilities
The customer remains responsible for its workers and workplace obligations, including risk assessments, welfare procedures, emergency plans and timely human response. The customer must:
- configure schedules, timezones, supervisors, escalation contacts and message wording accurately;
- keep worker availability and contact information current;
- monitor alerts and ensure responsible people can act when required;
- maintain an alternative process for outages, delivery failures and people who cannot or do not receive SMS;
- train authorised users and workers on the role and limits of Cheqzen; and
- independently assess what action is appropriate in every safety situation.
An SMS reply, delivery receipt or lack of alert is evidence recorded by the service, not proof of a person's actual safety.
4. Worker and supervisor information
The customer must have a lawful basis and any required authority or consent to provide personal information and send safety messages. It must give workers and supervisors appropriate notice about the workflow, message frequency, escalation, records and privacy. The customer must not add a mobile number it is not authorised to use.
5. Accounts, roles and security
Accounts are for individual authorised users and must not be shared. Users must keep credentials and authentication factors secure. The customer controls its administrators and must promptly remove access that is no longer required. The first purchaser may be invited as the Owner-Admin after successful paid checkout or eligible trial checkout and provisioning. Cheqzen may require multi-factor authentication, fresh verification or other security controls for protected actions.
6. Plans, seats and add-ons
Your checkout or order identifies the plan, billing interval, worker allowance and add-ons. Unless the order states otherwise:
- each plan includes five administrator seats;
- each Additional Administrator Pack adds five seats and packs may be stacked;
- every retained worker record counts toward the worker allowance, whether active or inactive;
- removing a worker from the current roster may free a seat, but historical safety and audit evidence may be retained;
- a worker may have up to three scheduled check-ins per calendar day, including weekends;
- standard messages are limited to 150 GSM-7 characters and one SMS part;
- Extended Safety Messages permit up to 290 GSM-7 characters and two SMS parts; and
- unsupported characters, emoji or content that exceeds the applicable limit may be rejected.
Entitlements are enforced by the platform. The customer must reduce usage or purchase an appropriate upgrade before exceeding a limit.
6A. Seven-day free trial
One seven-day trial is available per eligible business. We may request clarification where business details match an existing account. Shared payment details alone do not establish misuse. A trial cannot be used to bypass service limits.
The trial starts after eligible checkout, payment-method confirmation and billing consent. The displayed expiry is authoritative. It includes Micro Business capacity: 10 workers, 5 administrators, up to 3 scheduled check-ins per worker per day, and standard 150-character safety messages. Paid add-ons are not active during the trial.
No subscription charge is taken during the trial. A valid card is required and Stripe may perform a temporary verification. Unless cancelled before the displayed expiry, Micro Business starts at $149 per month, or the exact post-trial plan and interval subsequently selected and confirmed by the Owner-Admin. GST is not currently charged. Annual billing is charged in full, not in monthly instalments.
A post-trial plan selection does not increase trial capacity. Paid capacity begins after payment is confirmed. Add-ons can be purchased after paid activation.
Cancel through protected Plan and billing before trial expiry to avoid the first subscription charge. Access continues to the original expiry. Cancellation does not delete the account or its history. If the first payment fails, new operational activity pauses without a grace period; already-started safety follow-up continues.
Payment recovery or paid reactivation restores the existing organisation after confirmed payment, subject to current plan availability and capacity. A returning cancelled account starts a new paid billing period, not another free trial. Missed check-ins are not replayed. Records remain subject to the Privacy Policy and applicable obligations. Our emergency-service limits and your safety responsibilities still apply.
7. Prices, payment and renewal
Prices are shown in Australian dollars. GST or other taxes are included or added only where required and as displayed at checkout or on the invoice. Subscriptions are paid in advance by an accepted payment method. Except for an eligible free trial under section 6A, the first successful payment is required before the customer portal is provisioned.
Monthly subscriptions renew each month and annual subscriptions renew each year on the applicable anniversary date unless cancelled before renewal. The payment provider may securely store and charge the selected payment method. The customer authorises recurring charges for the plan, selected add-ons, applicable quantities and taxes shown at checkout.
Annual pricing may include a saving compared with twelve monthly payments. The precise price and any discount shown at checkout control. Add-ons may use a different annual calculation, and a Dedicated Australian SMS Number may not receive the base-plan annual discount.
8. Failed payments and grace period
If an established paid subscription renewal fails, the billing contact may receive a notice and the portal shows the payment status. The payment-recovery period is seven days from the failed renewal. If payment remains outstanding, new check-ins and new operational activity pause. There is no grace period for a failed first payment after a free trial. Safety workflows already underway continue their existing follow-up process. Billing, history and support remain accessible while the account is retained. Maintain alternative safety procedures during any interruption. Outstanding amounts remain payable.
9. Cancellation, plan changes and refunds
A customer may request cancellation through the available billing controls. Cancellation takes effect at the end of the current paid billing period, or the original trial expiry for a free trial, unless the law requires otherwise. Access continues until that date and the subscription will not renew afterward.
Payments are not refundable merely because the customer changes its mind, stops using the service or cancels part way through a paid period. This does not exclude any refund, remedy or other right that cannot lawfully be excluded under the Australian Consumer Law or other applicable law. We may provide a credit or refund at our discretion without creating an ongoing obligation.
Plan and quantity changes may take effect immediately or at the next renewal as clearly shown before confirmation. A downgrade cannot take effect while current usage exceeds the proposed allowance.
10. SMS messaging and opt-outs
Cheqzen safety messages are operational messages initiated under the customer's configured workflow. Customers must not use the service for unsolicited marketing, advertising, bulk promotion or unrelated communications. They are responsible for consent, sender identification and other legal obligations that apply to their messaging.
If a recipient replies STOP or otherwise makes a recognised opt-out request, further Cheqzen safety messages to that destination may be suppressed. The customer must not bypass suppression by editing the number, changing sender routes, recreating a record or directing Cheqzen to clear the status without a lawful and verified basis. The customer must immediately arrange another suitable safety process for that person.
11. Dedicated Australian SMS Numbers
A Dedicated Australian SMS Number is a paid, Platform Admin controlled add-on. Payment does not guarantee immediate assignment. Provisioning depends on provider availability, verification and Cheqzen's security checks. We aim to complete ordinary provisioning within two business days and will communicate material delays.
Customers cannot access the number registry, select an unverified sender or change routing themselves. If a dedicated assignment is removed or ends, routing may return to the Cheqzen Australia default. Historical messages retain evidence of the sender used at the time. Released numbers may be held in cooldown and later reassigned where lawful and operationally safe.
12. Acceptable use
The customer and its users must not:
- use Cheqzen unlawfully, deceptively, abusively or outside its safety check-in purpose;
- send spam, harassment, threats, discriminatory material, malware or prohibited content;
- impersonate another person or share accounts;
- attempt to bypass access controls, plan limits, SMS suppression, audit records or security protections;
- probe, disrupt, reverse engineer or overload the service except where a right cannot legally be excluded;
- upload information they are not authorised to collect or use; or
- use Cheqzen as the sole control for a foreseeable emergency or high-risk activity.
13. Availability and third-party services
We take reasonable care in operating Cheqzen but do not promise uninterrupted or error-free service. SMS transmission and delivery can be affected by telecommunications networks, mobile coverage, devices, spam filtering, provider outages and incorrect contact details. Hosting, authentication, payments and communications depend on third-party services. We may perform maintenance, make security changes or temporarily limit a feature where reasonably necessary.
14. Customer data and privacy
The customer retains its rights in information it supplies. It gives Cheqzen the limited right to host, process, transmit, back up and display that information as necessary to provide, secure and support the service and comply with law. Each party must comply with applicable privacy obligations. Our handling of personal information is described in the Privacy Policy.
We may use aggregated or de-identified information to operate, secure and improve Cheqzen, provided it does not reasonably identify a person or customer.
15. Intellectual property
Cheqzen and its licensors own the platform, website, software, branding, documentation, templates and related intellectual property, excluding customer data. Subject to these terms and payment where due, including any approved free trial, we grant the customer a limited, non-exclusive, non-transferable right to use the service internally during the subscription.
Feedback may be used to improve Cheqzen without payment or obligation, provided we do not publicly identify the person or customer without permission.
16. Suspension and termination
We may suspend or restrict access where reasonably necessary because of unpaid fees after any applicable grace period, a failed first post-trial payment, a material breach, unlawful or unsafe use, a credible security risk, provider restriction or legal requirement. Where practical, we will explain the reason and provide a reasonable opportunity to remedy it. Urgent action may be taken without advance notice to protect people, data or the service.
We may terminate for an unremedied material breach after reasonable notice. Either party may terminate where the other becomes insolvent or where continued performance becomes unlawful. Provisions concerning payment, historical records, privacy, intellectual property, liability and disputes survive where their nature requires it.
17. Data access when service ends
Before the subscription ends, the customer should export information made available through the platform. After ordinary subscription cancellation or payment suspension, billing, history and support remain available while the account is retained. Access may cease on account deletion or termination for legal, security or misuse reasons. Cancellation is not a promise of indefinite storage. We may retain or delete information in accordance with the Privacy Policy, legal requirements, backup cycles and safety or audit obligations. Termination does not require us to alter genuine historical audit evidence.
18. Australian Consumer Law
Nothing in these terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded. Where a guarantee applies and the law permits us to limit our liability for services, our liability is limited, at our option, to supplying the services again or paying the reasonable cost of having them supplied again.
19. Liability
To the maximum extent permitted by law, neither party is liable to the other for indirect, incidental or consequential loss, or for loss of profit, revenue, opportunity, goodwill or anticipated savings. This exclusion does not apply where the law does not permit it.
Cheqzen is not responsible for loss caused by the customer's failure to maintain appropriate safety procedures, respond to an alert, keep information accurate, secure user accounts or provide a working alternative during an outage. Nothing in these terms limits liability for fraud, wilful misconduct or another liability that cannot legally be limited.
20. Responsibility for misuse
To the extent permitted by law, the customer is responsible for reasonable losses and third-party claims caused by its unlawful use of Cheqzen, material breach of these terms, infringement of another person's rights or provision of information it was not authorised to use. Cheqzen must take reasonable steps to mitigate any claimed loss.
21. Changes to Cheqzen or these terms
We may improve or modify the service. We will not materially reduce a paid core feature during the current paid period without a reasonable operational, security or legal reason. We may update these terms prospectively and will provide reasonable notice of a material change. If a material change is reasonably unacceptable, the customer may cancel before it takes effect. Changes required urgently by law or security may take effect sooner.
22. Disputes
A party should first give the other written details of a dispute and allow at least 14 days for good-faith discussion, unless urgent relief is required. This does not prevent either party from contacting a regulator, exercising a non-excludable legal right or seeking urgent court orders.
23. Governing law
These terms are governed by the laws of New South Wales, Australia. The parties submit to the courts of New South Wales and courts entitled to hear appeals from them, subject to any mandatory law that requires a different forum.
